1. INTRODUCTION AND ACCEPTANCE
These Terms of Service ("Terms") constitute a legal agreement between TacticIQ ("Company") and you ("User") regarding the web platform and mobile application ("Service"). By downloading, installing or using the service you agree to these Terms. If you reside in the USA, these Terms include a class action waiver.
2. ELIGIBILITY AND AGE VERIFICATION
You must be at least 18 years old (or the age of majority where you live, if higher) to create an account and use the Service. You must provide your date of birth at registration for verification. We do not offer a parental consent onboarding path for ages 13–17. Users under 13: we do not knowingly collect personal information without verifiable parental consent where required (including COPPA). Age verification is required for regulatory compliance.
3. VIRTUAL ITEMS AND CURRENCY (NOT GAMBLING)
The Service includes "Points", "XP" or other virtual assets ("Virtual Items"). TacticIQ is not a betting or gambling platform; all items are part of a skill-based analysis game. No Ownership: You do not own Virtual Items; the Company grants a limited, revocable, non-transferable license. No Cash Value: Virtual Items cannot be converted to real money, refunded or sold outside the Company. This app does not offer paid loot boxes.
4. INTELLECTUAL PROPERTY AND COPYRIGHT
All rights in the Service belong to the Company. You represent that any content you upload (e.g. profile picture, chat messages) does not infringe copyright; we may remove content upon DMCA notice. Reverse engineering or distributing modified/cheat versions is prohibited.
5. CHAT AND COMMUNITY FEATURES
Content in chat and community areas is user-generated; the Company does not endorse it. We reserve the right to moderate and remove content. Chat and community features are intended for users who meet the eligibility requirements in Section 2. We are not liable for content posted by other users.
5A. AUTO-RENEWABLE SUBSCRIPTIONS (TACTICIQ PRO)
TacticIQ Pro is an auto-renewable subscription with a 12-month (annual) term; the price and term are shown on the purchase screen before you confirm. Payment is charged to your Apple ID account (App Store) or Google Play account at confirmation of purchase. The subscription renews automatically for the same term unless auto-renewal is turned off at least 24 hours before the end of the current period; your account will be charged for renewal within 24 hours prior to the end of the current period. After purchase, you can manage your subscription and turn off auto-renewal at any time in your App Store or Google Play account settings; cancellation takes effect at the end of the current period. Free trial: if a free trial is offered (for example, 14 days for eligible new subscribers), its length is shown before purchase; unless cancelled at least 24 hours before the trial ends, it converts automatically into a paid annual subscription, and any unused portion of a free trial is forfeited when you purchase a subscription. AI chat tokens are consumable purchases and are not part of the subscription. Refund requests for store purchases are handled by Apple or Google under their own policies. Where applicable, your use of the App is also subject to Apple's Licensed Application End User License Agreement (https://www.apple.com/legal/internet-services/itunes/dev/stdeula/).
6. RIGHT OF WITHDRAWAL (REGIONAL)
EU/France: For digital content purchases, performance begins immediately; by clicking "Purchase" you waive your 14-day right of withdrawal. Turkey: Under Distance Contracts Regulation Art. 15/ğ, services performed instantly in an electronic environment are excluded from the right of withdrawal. No refunds. Refunds for App Store and Google Play purchases are handled by Apple or Google under their policies (see section 5A).
7. ACCOUNT TERMINATION
We may terminate your account without prior notice for cheating, bot use, hate speech or breach of these Terms. No refunds for Virtual Items in terminated accounts.
8. DISCLAIMER OF WARRANTIES
The Service is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. The Company does not warrant that the Service will be uninterrupted, error-free, secure, or free of viruses or other harmful components. You use the Service at your own risk.
9. LIMITATION OF LIABILITY
To the maximum extent permitted by applicable law, in no event shall TacticIQ, its directors, employees, partners, agents, suppliers, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation loss of profits, data, use, goodwill, or other intangible losses, resulting from (a) your access to or use of or inability to access or use the Service; (b) any conduct or content of any third party on the Service; (c) any content obtained from the Service; or (d) unauthorized access, use, or alteration of your transmissions or content. TacticIQ's total aggregate liability shall not exceed the amount you paid to TacticIQ in the twelve (12) months preceding the claim.
10. INDEMNIFICATION
You agree to defend, indemnify, and hold harmless TacticIQ and its officers, directors, employees, and agents from and against any claims, damages, obligations, losses, liabilities, costs, or debt arising from: (a) your use of and access to the Service; (b) your violation of any term of these Terms; (c) your violation of any third-party right, including intellectual property or privacy rights; or (d) any content you submit or share through the Service.
11. GOVERNING LAW AND DISPUTE RESOLUTION
These Terms shall be governed by and construed in accordance with the laws of the Republic of Turkey, without regard to its conflict of law provisions. Any disputes arising out of or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the Ankara Courts and Enforcement Offices (Turkey). For users in the European Union, this clause does not affect your rights under mandatory consumer protection laws in your country of residence.
